In the vast majority of cases, litigation should be regarded as a means of dispute resolution of last resort. At Beckley Marshall Legal clients are encouraged to give consideration to resolving disputes if possible without the need to incur the time and cost invariably associated with going to court using a range of alternative dispute resolution processes.
Alternative dispute resolution is an umbrella term for processes, other than by way of court determination, in which parties seek to resolve issues between them.
The are a range of ADR processes that can be utilized as and if appropriate including:
- facilitative processes such as direct negotiations, informal settlement meetings and mediations;
- advisory processes such as expert appraisal or opinion; and
- determinative processes such as arbitration.
